Welcome to Thrive Together Group LLC ("Company," "we," "us," or "our"). We operate the e-commerce store hosted on Shopify (the "Site"). By accessing our Site and purchasing our physical games or digital products (collectively, "Products"), you agree to be bound by these Terms of Service ("Terms").

1. ACCEPTANCE AND ELECTRONIC CONTRACTING
  • Agreement: By using the Site, you represent that you are at least the age of majority in your state or province of residence.
  • Electronic Signature: Pursuant to the Florida Uniform Electronic Transactions Act (Fla. Stat. § 668.50), you agree that your "click-to-accept" or completion of a purchase constitutes a valid electronic signature and that this agreement carries the same legal force as a signed paper contract.

2. ACCOUNTS AND SECURITY
You are responsible for maintaining the confidentiality of your account credentials. You agree to provide current, complete, and accurate purchase information. We reserve the right to refuse service or terminate accounts at our sole discretion.

3. PRODUCTS AND SALES
  • Physical Products: Title and risk of loss for physical items (e.g., tabletop games) pass to you upon our delivery to the carrier.
  • Digital Products: Digital goods are licensed, not sold. We grant you a personal, non-exclusive, non-transferable license for personal, non-commercial use.
  • Taxes: For Florida residents, sales tax will be calculated based on the 6% state rate plus the applicable Sarasota County (or your specific county) discretionary sales surtax.
4. INTELLECTUAL PROPERTY (IP)
  • Ownership: All content, including game mechanics, artwork, logos, and digital code, is the exclusive property of Thrive Together Group LLC.
  • Restrictions: You may not reverse-engineer, decompile, or redistribute our digital products, nor may you "print and play" our digital assets for commercial resale without a specific commercial license from us.

5. PAYMENTS AND BILLING
All payments are processed through Shopify Payments or authorized third-party gateways. Pursuant to the Florida Deceptive and Unfair Trade Practices Act (FDUTPA), all fees are disclosed at checkout; no hidden "access fees" apply to your digital downloads.

6. REFUNDS AND CANCELLATIONS
  • Physical Goods: Returns are accepted within [7] days of receipt, provided the game is in its original shrink-wrap/seal.
  • Digital Goods: Due to the nature of downloadable content, all sales of digital products are final and non-refundable once the download link has been generated or accessed.
7. PROHIBITED CONDUCT
You are prohibited from using our Products to infringe upon our IP rights, upload malicious code, or engage in "scraping" the Site. Any unauthorized use of our game mechanics in a competing digital product is strictly prohibited.

8. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
  • "As-Is" Basis: Our Products are provided 'as is' without express or implied warranties.
  • Florida Liability Limitation: To the fullest extent permitted by Florida law, Thrive Together Group LLC shall not be liable for any injury resulting from the misuse of physical game components (including small parts) or failure to follow age-appropriateness warnings. Our total liability shall not exceed the amount paid for the specific Product in question.
9. GOVERNING LAW AND DISPUTE RESOLUTION
  • Jurisdiction: These Terms are governed by the laws of the State of Florida.
  • Venue: Any legal action must be brought exclusively in the state or federal courts located in Sarasota County, Florida.
  • Arbitration: You agree to resolve any disputes through binding arbitration under the American Arbitration Association (AAA) rules, waiving your right to participate in a class-action lawsuit.
